1. Introduction and Company Information

These terms and conditions apply to the agreement for services ("The Services") entered into between you as a customer ("the Customer", "you") and TryViet ("the Company", "we", "us"). Although our services are performed in Vietnam, all bookings and legal agreements are handled by our Swedish company and fall under Swedish law and European consumer legislation.

  • Modifications of Terms: TryViet reserves the right to update these terms at any time. The terms applicable at the time of your booking are the ones that govern the contract between us.

2. Scope and Limitations of the Services

TryViet provides coordination, assistance, and "soft-landing" packages (incl. The Arrival Essentials, Soft Landing, and The Premium Landing) for relocation to Da Nang, Vietnam. Our services are booked via Sweden, but the physical execution (e.g., property inspections, airport transfers, and eSIM handover) is delivered in collaboration with our selected and vetted local partners in Vietnam. The exact inclusions of your chosen package, as well as any add-on services, are stated in the service description on our website at the time of booking and are specified in your written booking confirmation.

Important limitations to note:

  • No Legal Advice: TryViet does not offer legal advice, direct visa processing, or immigration services. We can only refer you to trusted local visa agents. It is your full responsibility to ensure that you hold the correct visa and meet Vietnam's entry requirements.
  • Independent Advice: We act as an independent coordinator for you, not as real estate agents or representatives for local landlords.
  • Customer Obligations: It is your responsibility as a customer to provide accurate travel details and arrival times, respond to our communication within a reasonable timeframe, and act in accordance with applicable laws. Failure to do so may result in delays or limitations in the execution of the service, without the right to a refund.
  • Intellectual Property: All materials, including but not limited to guides (e.g., "Da Nang Neighborhood & Housing Guide"), shortlists, itineraries, and texts provided by TryViet, are the intellectual property of the Company and may not be copied, forwarded, sold, or publicly distributed without our written consent.

3. Pricing, Payment, and Taxes

We apply transparent, fixed pricing. As a general rule, our terms apply equally regardless of which country you book from, in accordance with the European Services Directive.

  • Currency and Fees: All prices are quoted in US Dollars (USD). There are no hidden fees.
  • Payment Structure: Payment is divided into two steps:
    • 50% Upfront Payment: Paid at the time of booking to secure your slot and to allow us to begin our preparatory work (such as research and video consultations).
    • 50% Final Payment: Due no later than 14 days (2 weeks) prior to your scheduled arrival in Da Nang.
  • Add-on Services: The cost for any add-on services is not paid in conjunction with the upfront payment. Instead, all selected add-ons are invoiced and paid in full together with your final payment (14 days prior to arrival).
  • Cancellation of Add-on Services: Add-on services are not binding at the time of booking. You may change or cancel your add-ons free of charge at any time up to 14 days prior to arrival (or before another legally agreed-upon deadline). If you cancel the main package and choose not to fulfill the final payment, your selected add-ons are automatically canceled at no cost.
  • VAT (Moms): For Swedish private individuals and companies, Swedish VAT applies (standard VAT rules). For customers based outside the EU, as well as corporate clients within the EU with a valid VAT number, the applicable tax rules for the export of services apply (reverse charge mechanism/zero-rated).

4. Statutory Right of Withdrawal (14 days)

When you purchase a service over the internet from a Swedish company, you generally have a 14-day Statutory Right of Withdrawal (Ångerrätt) under the Swedish Act on Distance Contracts. The withdrawal period begins on the day you make your booking and pay your upfront invoice.

  • Commencement of Service with Consent: Our service—consisting of planning, housing searches, and video consultations—often begins immediately after booking. By accepting these terms, you explicitly consent to us commencing the service during the 14-day withdrawal period.
  • Consequences of Withdrawal: Should you exercise your right of withdrawal within 14 days, but we have already commenced our work with your explicit consent, TryViet reserves the right to retain a proportionate share of the upfront payment (or invoice you) for the work already performed up until the time you notified us of your withdrawal.

5. Cancellations (Outside the Right of Withdrawal)

If you need to cancel your package after the statutory 14-day right of withdrawal has passed, the following applies:

  • Cancellation more than 14 days prior to arrival: The initial 50% upfront payment is non-refundable, as this covers our invested time and the reserved resources of our partners. However, you are not obligated to pay the final 50% of the invoice.
  • Cancellation less than 14 days prior to arrival: If the cancellation occurs less than 14 days before your scheduled arrival, the full amount (100%) becomes due, and no refunds are issued, as all local resources, vehicles, and agreements in Vietnam have already been locked in and prepaid.

6. Limitation of Liability and Force Majeure

  • Third Parties: We are not liable for breaches of contract, damages, or disputes that arise directly between you and a third party (such as landlords, cleaning companies, or transport providers). If you experience issues with your apartment (e.g., Wi-Fi or plumbing), we act as a mediator on your behalf during your stay (according to your chosen package), but we bear no legal or financial responsibility for the landlord's property.
  • Force Majeure: TryViet is exempt from liability for failure to fulfill certain obligations under this agreement if the failure is due to extenuating circumstances such as natural disasters, war, pandemics, strikes, or sudden local regulatory changes in Vietnam.

7. Applicable Law and Dispute Resolution

This agreement shall be construed and governed in accordance with Swedish law.

  • Complaints & Rectification: If you experience faults or deficiencies in the Service, you must notify us within a reasonable time (complaint) so that we are given the opportunity to rectify the problem on-site. Complaints should be submitted in writing to support@tryviet.com.
  • Dispute Resolution: We always strive to resolve any complaints or misunderstandings directly with you through open dialogue. In the unlikely event that a dispute cannot be resolved amicably, you, as a consumer, have the right to turn to the National Board for Consumer Disputes (ARN) in Sweden, or use the EU Commission's Online Dispute Resolution (ODR) platform. Customers outside the EU are covered by the protections of this agreement, but disputes are primarily settled under Swedish law and through Swedish courts, unless mandatory consumer protection laws in the customer's home country dictate otherwise.
  • Language and Precedence: The original version of these terms is written in Swedish. In the event of any legal disputes or discrepancies arising from translations into English or other languages, the Swedish version and the Swedish consumer law framework shall take precedence.
